1. About these Terms and Conditions

PLEASE READ THE FOLLOWING CAREFULLY BEFORE ACCESSING AND/OR USING ANY PART OF THE WEBSITE.

Please read these terms and conditions carefully before using the Website.

By accessing or using the Website, you expressly acknowledge and agree that you are entering a binding legal agreement with us and have understood and agree to comply with, and be legally bound by, these terms and conditions together with the Privacy Policy that can be accessed by clicking here.

If you do not agree to be bound by these terms and conditions, please do not access or use the Website.

We are Taylor & Tails Ltd (“we” or “us” ). We are registered in England and Wales under company number 13300863.

2. Our contract with you

Our acceptance of your order will take place when we email you to inform you of our acceptance, at which point a contract will come into existence between you and us, subject to these terms and conditions.

We warrant that the Products will be of satisfactory quality.

If we are unable to accept your order, we will inform you of this and will not charge you for the Products. This might be because the Products are out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because we have identified an error in the price or description of the Products or because we are unable to meet a delivery deadline you have specified.

3. Your right to make changes

If you wish to make a change to the Products you have ordered, please contact us. We will let you know if the change is possible. If it is possible, we will let you know about any changes to the price of the Products, the timing of supply, or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to proceed. We make no guarantees that we will be able to accommodate any requests to change the Products.

4. Delivery

UK customers

The costs of delivery will be as displayed to you on our Website.

If you are ordering for delivery within the UK, deliveries are free of charge, subject to courier restrictions. For more information on UK shipping services and charges please see our Delivery and Returns page

International customers

If you are ordering for delivery outside the UK, delivery options and related charges will be presented to you as part of the order process where available. If there are no options for delivery of the Products you ordered on the Website, (for example because the order for the Products is particularly large, or because our standard couriers do not deliver to the country specified) shipping charges will not be applied to your order at the time you place it on our Website. Instead, on receipt and acceptance of your order by us, we will contact you with a confirmed shipping quote and send an electronic invoice for the shipping charges. We will wait for your confirmation as to whether to not you wish to proceed and for full payment of the shipping charges to be made before accepting the order. 

Additional information for international customers

If you order Products for delivery outside the United Kingdom, duties and taxes may apply depending on the destination country. We are not responsible for any of these charges and we undertake to make no calculations or estimates in this regard.  If you are buying for delivery outside the United Kingdom you are advised to contact your local customs authorities for further details on costs and procedures.

As the purchaser, you will also be the importer of record for the destination country and as such should ensure that your purchase complies with the laws and regulations of the destination country. Please be advised that your Products are opened and inspected on arrival at port for customs purposes. Therefore, we cannot guarantee that the packaging of your Products will be unopened/ tampered with.  Please also be aware that the United Kingdom consumer protection laws may not apply.

5. Limitation on Liability

(a) Nothing in these terms and conditions will limit our liability for death or personal injury resulting from our negligence or that of our employees or agents. If you are a consumer (within the meaning of the Unfair Contract Terms Act 1977) the content of these terms and conditions will not affect your statutory rights. If you are not a consumer then all other warranties, conditions, or other terms, whether implied by statute common law or otherwise, are excluded to the fullest extent permitted by law. 

(b) IN ANY EVENT, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY BREACH OR SERIES OF BREACHES UNDER OR IN CONNECTION WITH THESE TERMS AND CONDITIONS SHALL NOT EXCEED THE VALUE OF THE RELEVANT ORDER PLACED BY YOU.

(c) We shall have no liability for loss of profit or any indirect, special, or consequential loss or damage, costs, expenses, or other claims for compensation whatsoever arising out of or in connection with the supply or non-supply of the Products (including any delay in supplying the Products) or their use or resale by you. Save in respect of our liability under clause 4 (a), our entire liability arising out of any order for Products from you will be limited to the total price of the Products ordered by you. 

(d) Where we provide any information concerning the Products supplied to us by a third party, we do not give any warranty, guarantee as to its accuracy, or otherwise and shall have no liability to you for any losses arising as a result thereof.  

(e) You must observe and comply with all applicable regulations and legislation, including all necessary customs, import or other permits to purchase Products from our Website. The importation or exportation of our Products may be prohibited by certain national laws. We accept no liability in respect of the import or export duties of compliance with any laws for the Products you purchase.

6. Disclaimer

Scratch resistance: while the Products are scratch resistant and will withstand even deep scratches made by dogs, in some cases scratches will leave marks on the fabric. We shall have no liability to you whatsoever for any scratches or rips in the fabric unless the Product was faulty when delivered.

Whilst the fabric of the Products is strong, it is not indestructible and if someone cuts it with a sharp object such as a knife, or if your dog is a particularly aggressive chewer, it may rip. The beds are also not completely waterproof if liquid is left in the bed for long periods. In addition, some larger breads of dog may try to dig into the bed continuously which may rip the fabric. Accordingly, we make no representations or warranties to you regarding the indestructibility of the fabric and shall have no liability to replace the Products if there are rips, scratches, the product is ruined by liquid or the Product breaks (excluding a faulty product).

Any failure to follow the information regarding caring for and using the Products correctly shall be deemed misuse of the Product. We shall have no liability to you for any misuse of the Products or the consequences.

7. Your rights to end the contract

Your rights when you end the contract will depend on what you have bought, whether there is anything wrong with it, how we are performing, and when you decide to end the contract:

Ending the contract because of something we have done or are going to do: If you are ending a contract for a reason set out at (a) to (e) below, the contract will end immediately, and we will refund you in full for any of the Products which have not been provided. 

The reasons are:

(a) we have told you about an upcoming change to the Products or these terms which you do not agree to;

(b) we have told you about an error in the price or description of the Products you have ordered and you do not wish to proceed;

(c) there is a risk that the supply of the Products may be significantly delayed because of events outside our control;

(d) we have suspended supply of the Products for technical reasons, or notify you we are going to suspend them for technical reasons, in each case for more than 7 days; or

(e) you have a legal right to end the contract because of something we have done wrong.

8. How to end the contract with us

If you change your mind after placing an order, you can cancel it at any time, providing we receive notice of this cancellation before we have sent our dispatch email to you.

To cancel your order, you will need to give us your name and address details, as well as your order number. Please contact us at support@taylorandtails.com or telephone 0044 (0) 1780 723815 between 9am and 5pm Monday to Friday.

9. Returns Policy

We shall be under no liability to you for any loss, damage, costs, expenses, or other claims in respect of (a) any defect arising from wilful damage, negligence, failure to follow instructions for the use of the Products (whether oral or in writing); (b) misuse or alteration of the Products without our approval; (c) arising from any information supplied by you which is incomplete, inaccurate, illegible, out of sequence or in the wrong forum, or any other fault of the customer.

If you are dissatisfied with your order, the Products delivered to you are incomplete, faulty or you have received incorrect Products, we shall have no liability to you unless you notify us of the issue as soon as possible and in any event within three days of receiving the Products.

A Product is only deemed ‘faulty’ if, after you return the Product to us, we agree that the fault is not due to reasonable wear and tear, inappropriate use or wilful/deliberate damage inflicted by you or a third part after you received the Product.

If you notify a problem to us correctly per the paragraph above and the Product is faulty or is not of satisfactory qualify etc, the following shall apply:

(a) We may offer you an alternate Product or we will replace the Product free of charge within 60 days of notification by you to us, provided that the original Product is returned to us per clauses 8 and 9;

(b) We will refund you the shipping costs if you return the Product in accordance with clause 10; 

(c) If you choose an alternative Product and that alternative Product is more expensive than the original Product you ordered, you shall be liable to pay the difference between the original Product you ordered and the alternative Product plus additional shipping fees.

10. Returns Procedure

 If you exercise the right to cancel, or a right to return the Product(s), to make the returns procedure as efficient as possible we advise you to adhere to the following procedure:

  1. Please contact us at support@taylorandtails.com to obtain a returns authorisation number before sending the Product(s) back;
  2. Send the Product(s) and all of the original packing materials/packing slip in a wrapped cardboard box (the post office has these available if you do not);
  3. Print your name and address on the outside of the package in the sender's details area and mail the package to: Taylor & Tails Ltd, 4 Tennyson Way, Stamford, PE9 2GZ, UK

For your protection, we advise you to return your product using recorded or signed for delivery. We accept no responsibility for items lost or damaged whilst in transit.

11. Conditions of Return

The following conditions shall apply to all Products you wish to return to us: 

(a) you shall be liable for the cost incurred in returning Products to us and we shall not be obliged to accept any Product returned if such costs have not been paid in full;
(b) we are under no obligation to refund the shipping costs paid by you for the Products; and
(c) each item must be returned in the same condition as it was sent, unused and undamaged. Damaged goods due to your negligence will not be accepted for refund.

Subject to the conditions in (a)-(c) above, we will refund the full cost of the Product(s). However, Products returned for an incomplete refund, have been used, or otherwise soiled will be subject to a minimum restocking fee of 15%, or maybe refused if the condition of the item is deemed non-returnable. Refunds will be made in the same form as the original purchase.

All requests for refunds will be processed after we have inspected and verified the condition of the Products. Returns take approximately five business days to process upon receipt of the item.

12. Pricing and payment

Prices for Products throughout the Website are quoted in pounds sterling and payment can only be accepted in pounds sterling. All prices include VAT where applicable. Prices quoted on our Website apply exclusively to Products purchased through this Website. 

While we make every effort to ensure that the Products shown on our Website are currently available at the price shown, we cannot guarantee that this will always be the case. If Products you have ordered online are unavailable at the price or conditions are shown, you will be notified as soon as possible.

If a pricing error is made on our Website or in the ordering process, we will inform you as soon as possible and give you the option of buying the Products at the correct price or cancelling the order. If we cannot get in contact with you to notify you of the error, your order will be cancelled. In those circumstances, no payment will be taken from you or, if applicable, any payment taken in advance will be refunded.

Your card will be debited once your order is placed. You will then receive an order confirmation email.

We will aim to inform you as soon as possible if there is an issue with the payment authorization process or with any validation checks for your order. We will not accept your order if payment is not authorised. Where there are issues with the authorisation process or validation checks, your delivery may be delayed as a result.

If we experience issues with the receipt of your payment or we are unable to dispatch the Products, a full refund will be given and this contract will terminate.

13. Changes to terms and conditions

We reserve the right to change these terms and conditions from time to time. If this happens, we will post the new terms and conditions on the Website. You are responsible for ensuring that you check our Conditions from time to time to take notice of any changes we make, as they are binding on you. If you do not wish your purchases or orders to be governed by the revised terms and conditions, you must not place any further orders. By using the Website or buying Products through the Website, you will be accepting the changes.

14. Other important terms

By using the Website you confirm that you are at least 16 years old, or, if you are under 16, that you are accessing the Website with the consent of your parent or guardian. 

Neither party shall be in breach of these terms and conditions nor be liable for delay in performing, or failure to perform, any of its obligations under these terms and conditions if such delay or failure result from events, circumstances or causes beyond its reasonable control. 

We may transfer your rights under these terms and conditions to another business where we reasonably believe the Customer’s rights will not be affected. If you breach these terms and conditions and we choose to ignore this, we will not be prevented from using our rights and remedies at a later date or in any other situation where you breach these terms and conditions.

We shall not be responsible for any breach of these terms and conditions caused by circumstances beyond our reasonable control.

If you are a consumer, please note that these terms and conditions, their subject matter, and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland.

If you are a business, these terms and conditions, their subject matter, and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales. If any part of these terms and conditions is found to be invalid by law, the rest of them remain valid and enforceable.

These terms and conditions set out the entire agreement between you and us in respect of the sale, purchase, and use of the Products. They supersede any previous agreement or understanding concerning the subject matter hereof. No variation of these terms and conditions is binding on us unless agreed by us in writing.
